01Acceptance of Terms & Regulatory Compliance

1.1 Acceptance

By accessing or using the Platform, you ("User," "Applicant," "Student," "Parent," "Guardian," or "you") agree to be bound by these Terms, our Privacy Policy, applicable Data Protection Policy, and all other guidelines referenced herein. Your continued use following any modification constitutes acceptance of the modified Terms.

1.2 Authority to Bind

If you access the Platform on behalf of a minor, or as a parent or guardian, you represent and warrant that you have full legal authority to bind that individual to these Terms. Where a User is a minor, additional requirements applicable to the processing of a child's personal data are set out in Section 16.9.

1.3 Regulatory Compliance Statement

Foreign EduLoans operates as a loan facilitation and advisory platform and seeks to comply with applicable laws and regulations, including the Digital Personal Data Protection Act, 2023 ("DPDPA"). Foreign EduLoans does not itself undertake lending activities and functions as a loan facilitator and advisor.

1.4 Other Services

In addition to education loan facilitation, Foreign EduLoans may from time to time offer or facilitate access to related services, including visa assistance, admissions counselling. Such other services, where offered, may be governed by additional or separate terms made available to you at the relevant time, and are provided subject to the disclaimers in Section 14. In the event of any conflict between these Terms and terms specific to another service, the service-specific terms shall govern in relation to that service only.

02About Foreign EduLoans

Foreign EduLoans is an education loan assistance and advisory platform helping Indian students and families navigate the process of securing education loans for studies in India or abroad.

We partner with a network of RBI-regulated banks, NBFCs, and licensed financial institutions ("Partner Institutions" - see Schedule A for the full definition) to help students identify suitable loan products and assist through the application process. Partner Institutions referenced or presented on the Platform as our partners are formally associated with Foreign EduLoans under a written arrangement; other lenders may be shown for general comparison purposes only and should not be understood as a Partner Institution unless expressly identified as such.

Regulatory Status: Foreign EduLoans is a loan aggregator/facilitator and is not a lender or credit provider.

Fees: Foreign EduLoans does not charge Users any service fee for loan facilitation. Foreign EduLoans' compensation model is described in Section 17.5.

03Nature of Services

Foreign EduLoans provides the following advisory, administrative, and facilitative services:

  • Understanding loan requirements, course, destination, and financial profile;
  • Providing preliminary, indicative eligibility assessments;
  • Presenting comparisons of loan options from Partner Institutions;
  • Collecting required documents from Users and conducting preliminary checks before forwarding them to the relevant Partner Institution, as described in Section 7.1;
  • Coordinating communication between User and Partner Institutions;
  • Assisting with loan application submission;
  • Tracking and providing status updates on applications; and
  • Providing general support from application until loan disbursement.

Critical Disclaimer

  • These Services are advisory, administrative, and facilitative ONLY.
  • Foreign EduLoans does NOT perform functions reserved for licensed banks or NBFCs.
  • Foreign EduLoans makes NO credit decisions, underwriting assessments, or risk determinations.
  • Foreign EduLoans provides general guidance only and NOT financial or legal advice.
04Foreign EduLoans Is Not a Lender - Critical Disclaimer

4.1 No Lending Function

Foreign EduLoans is NOT a bank, NBFC, financial institution, lender, or loan originator and does not itself undertake lending activities. Foreign EduLoans does not itself approve, sanction, disburse, or service loans.

Any regulatory obligations applicable to Foreign EduLoans in connection with its activities or arrangements with Partner Institutions shall be governed by applicable law.

4.2 Exclusive Functions Disclaimed

Foreign EduLoans does NOT, at any point:

  • Lend, disburse, advance, or extend any money;
  • Approve, sanction, or reject any loan application;
  • Set, determine, negotiate, or influence interest rates or processing fees;
  • Decide repayment schedules, tenure, or moratorium periods;
  • Influence credit underwriting, risk assessment, or KYC decisions;
  • Guarantee any loan will be approved or disbursed;
  • Guarantee any specific processing or disbursement timeline;
  • Accept loan repayment or collect loan amounts; or
  • Modify or provide relief from loan terms.

4.3 Sole Lending Authority

All lending decisions including approval, rejection, sanction amount, interest rate, tenure, collateral requirements, and disbursement are made solely by the relevant Partner Institution in accordance with its internal credit policy, RBI guidelines, and applicable law.

Foreign EduLoans has no control over and accepts no responsibility for such decisions, except to the extent liability arises from Foreign EduLoans' own acts, omissions, negligence, wilful misconduct, or breach of applicable law.

4.4 No Lender-Borrower Relationship

Submitting an application through the Platform does NOT:

  • Create any obligation on any Partner Institution to approve a loan;
  • Create any lender-borrower relationship between User and Foreign EduLoans;
  • Create any implied contract or binding commitment; or
  • Transfer liability to Foreign EduLoans for actions of a Partner Institution, except to the extent liability arises from Foreign EduLoans' own acts, omissions, negligence, wilful misconduct, or breach of applicable law.
05Eligibility & Non-Discrimination

5.1 Eligibility Requirements

To use the Platform, you must:

  • Be at least 18 years of age, or use the Platform with parent/guardian involvement if a minor;
  • Be capable of entering into a legally binding contract under the Indian Contract Act, 1872;
  • Provide accurate, current, and complete information as requested;
  • Not be barred from using the Platform under applicable law; and
  • Not be subject to applicable economic sanctions or export-control restrictions.

5.2 Partner Institution Eligibility

Eligibility for a specific loan product is determined solely by the relevant Partner Institution based on academic profile, co-applicant income, collateral availability, credit history, visa status, and its lending-policy criteria.

5.3 Processing of a Minor's Personal Data

Where the Platform is accessed by, or personal data of, an individual below eighteen years of age is collected in connection with a Service, Foreign EduLoans shall process such personal data only on the basis of verifiable consent of the parent or lawful guardian of that minor, obtained in the manner required under the DPDPA and rules made thereunder.

Foreign EduLoans shall not undertake tracking or behavioural monitoring of a minor, or targeted advertising directed at a minor, except where permitted under the DPDPA and rules made thereunder.

A parent or guardian providing consent under this clause represents that they are verifiably identified as the parent or lawful guardian of the minor concerned.

06User Responsibilities & Obligations

6.1 Information Accuracy

You shall:

  • Provide true, accurate, current, and complete personal, academic, and financial information;
  • Furnish only genuine and authentic documents;
  • NOT submit any forged, altered, fabricated, or materially misrepresented documents; and
  • Update information promptly if circumstances change.

6.2 Responsiveness & Cooperation

You shall:

  • Promptly respond to requests for information or documents;
  • Cooperate fully with KYC, verification, and compliance procedures; and
  • Communicate any changes in eligibility status.

6.3 Independent Due Diligence

You should:

  • Independently review and understand terms, interest rates, fees, conditions, and repayment schedules offered by Partner Institutions;
  • Consult a qualified financial advisor or chartered accountant before committing where appropriate; and
  • Review all loan documents before signing.

6.4 Legal Compliance

You shall:

  • Comply with all applicable laws while using the Platform;
  • Ensure information provided complies with applicable income-tax, KYC, foreign-exchange, and other legal requirements; and
  • Not use the Platform for any unlawful purpose.

6.5 Document Submission & Data Security

Documents and information may be submitted to Foreign EduLoans through [Insert Document Submission Channel(s) e.g., email, WhatsApp, or such other means as Gateway may designate. Where a channel involves an account, login, or access credential, you shall maintain the confidentiality of such credentials, not share access with unauthorised persons, and promptly notify Foreign EduLoans of any unauthorised access attempt.

6.6 No Misuse

You shall not:

  • Misuse the Platform, its content, or personal data of third parties;
  • Engage in harassing, defamatory, or threatening behaviour; or
  • Reverse-engineer, scrape, or extract Platform code or data.
07Document Verification, Information Accuracy & Liability for False Information

7.1 Foreign EduLoans' Document Checks and User Responsibility for Accuracy

Foreign EduLoans reviews documents you submit for administrative completeness and to check, on their face, that they appear to be genuine and consistent with the information provided, before forwarding them to the relevant Partner Institution. This review does not constitute legal, regulatory, KYC, credit, underwriting, or independent forensic authentication of the documents, and does not substitute for the Partner Institution's own verification and acceptance processes.

Final verification and acceptance of documents shall remain with the relevant Partner Institution. You remain responsible for the accuracy, completeness, and authenticity of the information and documents provided by you.

7.2 No Liability for Inaccurate Information

Foreign EduLoans shall NOT be liable for any delay, rejection, adverse consequence, or financial loss arising from inaccurate, incomplete, outdated, misleading, false, or altered information or documentation provided by you, except to the extent such loss arises from Foreign EduLoans' own negligence in conducting the checks described in Section 7.1.

7.3 Legal Consequences for Fraudulent Information

Providing false, fraudulent, or materially misleading information may result in:

  • Immediate rejection of your loan application;
  • Cancellation of any disbursed loan, where permitted by the relevant loan agreement and applicable law;
  • Reporting to law-enforcement authorities; and
  • Legal proceedings under applicable law.
08Consent to Contact Phone, WhatsApp, SMS & Email

8.1 Operational Communications

By registering on or submitting details through the Platform, you consent to being contacted by Foreign EduLoans and, where applicable, Partner Institutions, via phone calls, WhatsApp messages, SMS/text messages, email, or other electronic communication channels you have provided, for purposes necessary to process your application, provide status updates, request documents, and otherwise deliver the Services you have requested ("Operational Communications").

8.2 Promotional Communications

Separately, Foreign EduLoans may seek your consent to send promotional or marketing communications regarding its own Services or those of Partner Institutions ("Promotional Communications"). Promotional Communications will be sent only where you have separately consented to receive them, and such consent is not a condition of receiving the Services.

You may opt out of Promotional Communications at any time by replying STOP to any message, or writing to info@foreigneduloans.com, without affecting your ability to receive Operational Communications or otherwise use the Platform.

8.3 Do Not Call / Regulatory Compliance

Communications will be made in accordance with applicable consent, telemarketing, and Do Not Call requirements.

8.4 Withdrawal of Consent

You may withdraw consent at any time by writing to our Grievance Officer at the contact details in Section 21.

Withdrawal will not affect the lawfulness of processing carried out before withdrawal. However, withdrawal of consent to Operational Communications may limit or prevent our ability to process your loan application, provide status updates, assist with document collection, or coordinate with Partner Institutions. We will explain the relevant consequences where applicable.

09Consent for Information Sharing with Partner Institutions

9.1 Express Authorisation

You authorise and consent to Foreign EduLoans collecting, storing, and sharing your personal, academic, financial, and admission-related information and documents with Partner Institutions solely for the purpose of processing your education-loan application.

This consent is necessary for, and limited to, providing the loan-facilitation Service you have requested. It does not extend to marketing uses of your data, which are governed by Section 8.2 and the Marketing Consent provisions of our Privacy Policy.

9.2 Partner Institution Data Processing

You understand and agree that:

  • Once shared, the Partner Institution may process your data in accordance with its own privacy policy and applicable law;
  • Foreign EduLoans does not control Partner Institution data practices;
  • Partner Institutions may contact you directly using information provided; and
  • Partner Institutions are independently responsible for their own applicable data-protection obligations.

Foreign EduLoans will facilitate information exchange between you and the relevant Partner Institution.

9.3 Service Providers Acting on Foreign EduLoans' Behalf

Foreign EduLoans does not share your personal data with any third party other than Partner Institutions. Where Foreign EduLoans engages hosting, IT infrastructure, verification-support, or similar service providers to support the Platform, such service providers process personal data solely on Foreign EduLoans' documented instructions and solely to enable Foreign EduLoans to operate the Platform and deliver the Services ("Processors"). Processors are contractually bound to process personal data only for such purposes, to maintain confidentiality, and to implement appropriate security safeguards. Engagement of a Processor does not constitute sharing of your data with an independent third-party recipient for the purposes of Section 9.1.

9.4 Withdrawal of Consent

You may withdraw this consent at any time, subject to Section 8 above, and subject to information already lawfully processed prior to withdrawal.

If you withdraw consent, Foreign EduLoans may not be able to continue processing your application.

10Loan Approval Disclaimer

10.1 No Guarantee of Approval

Foreign EduLoans makes NO representation, warranty, or guarantee express or implied that any loan application submitted through the Platform will be approved, sanctioned, or disbursed by any Partner Institution, or that any specific loan amount, interest rate, or tenure will be available.

10.2 Indicative Assessments

Any indicative eligibility assessment or pre-qualification estimate provided through the Platform:

  • Is for general guidance only;
  • Does NOT constitute a loan offer, commitment, disbursal, or sanction;
  • Is based on information supplied by the User and information available to Foreign EduLoans; and
  • May change based on the Partner Institution's actual assessment.

10.3 Partner Institution Discretion

Final approval is at the sole discretion of the Partner Institution, based on its internal credit policy, underwriting norms, risk assessment, factors not disclosed to Foreign EduLoans, applicable RBI guidelines, and the borrower's eligibility at the time of application. Any indicative guidance shared by Foreign EduLoans' sales or counselling personnel regarding a possible approval outcome, interest rate, or processing timeline is for general reference only and does not constitute a binding representation, warranty, or guarantee.

11Interest Rate & Financial Terms Disclaimer

11.1 Indicative Nature of Rates

Interest rates, processing fees, margin-money requirements, and all other financial terms displayed on the Platform are indicative only, sourced from information provided by Partner Institutions or publicly available information at the relevant time, and are subject to change. Foreign EduLoans relies on such Partner Institution information without independently verifying every update, and updates rates on the Platform on that basis.

Such information does NOT constitute an offer or quote by Foreign EduLoans.

11.2 No Rate Setting or Negotiation

Foreign EduLoans:

  • Does NOT set, negotiate, determine, or guarantee any interest rate or fee;
  • Has NO control over a Partner Institution's rate determination; and
  • Cannot independently modify rates offered by Partner Institutions.

11.3 Final Terms Determined by Partner Institution

The actual interest rate, processing fee, and all charges applicable to your loan will be determined solely by the Partner Institution at the time of sanction and may differ from any figure displayed on the Platform or discussed during the advisory process.

11.4 Due Diligence Obligation

You are strongly advised to obtain and independently verify the final rate and fee schedule directly from the Partner Institution before accepting any offer, compare rates across multiple lenders, calculate the actual cost of borrowing including all fees and charges, and seek appropriate professional advice regarding suitability.

12Processing Time Disclaimer

12.1 Indicative Timelines Only

Any estimated timelines communicated by Foreign EduLoans for document verification, application processing, loan approval, or loan disbursement are indicative only and may be based on general experience or information shared by Partner Institutions.

12.2 Actual Timeline Determinants

Actual timelines depend on factors outside Foreign EduLoans' control, including the Partner Institution's internal processes and workload, applicant responsiveness, document verification, admission confirmation, visa processing, background verification, co-applicant procedures, and external service-provider delays.

12.3 No Liability for Delays

Foreign EduLoans shall NOT be liable for any loss, missed deadline, or damage arising from delays in loan processing, approval, disbursement, admission confirmation, visa approval, or document verification, except to the extent such liability cannot be excluded under applicable law.

Foreign EduLoans will make commercially reasonable efforts to facilitate processing but makes NO guarantee regarding timelines.

13Third-Party Services Disclaimer

13.1 No Control Over Third Parties

The Platform may refer or facilitate access to services offered by Partner Institutions and other third parties. Foreign EduLoans:

  • Does NOT control the products, services, policies, terms, or conduct of such third parties;
  • Does NOT endorse third-party services unless explicitly stated in writing;
  • Makes NO warranty regarding accuracy, quality, reliability, or suitability of any third-party service; and
  • Shall NOT be responsible for any act, omission, error, decision, breach, or misconduct committed by any Partner Institution or third party, except to the extent caused by Foreign EduLoans' own acts, omissions, negligence, wilful misconduct, or breach of applicable law.

13.2 Dispute Resolution for Sanctioned Loans

Any dispute regarding a sanctioned loan-including its terms, conditions, interest rates, charges, servicing, repayment schedule, or default action-must be raised directly with the concerned Partner Institution in accordance with that institution's grievance-redressal mechanism.

Foreign EduLoans is NOT a party to your loan agreement and is not entitled to offer loan servicing or to receive loan repayment money.

14No Financial or Legal Advice Disclaimer

14.1 Information Only

All content, tools, comparisons, analyses, and communications provided through the Platform are for general informational purposes only, do NOT constitute financial, investment, tax, or legal advice, and are NOT personalised recommendations for your specific situation.

14.2 No Professional Status

Foreign EduLoans:

  • Is NOT a SEBI-registered investment adviser;
  • Is NOT a chartered accountancy firm or tax adviser;
  • Is NOT a law firm or legal adviser; and
  • Does NOT employ licensed financial advisers or tax professionals except to the extent stated in writing.

14.3 Independent Professional Consultation

You are strongly encouraged to consult qualified professionals before making borrowing decisions, including:

  • A financial adviser regarding loan amount, affordability, and repayment capacity;
  • A chartered accountant regarding applicable tax implications; and
  • A legal professional regarding loan-agreement terms, collateral, security requirements, co-applicant liabilities, default, and legal rights and remedies.

14.4 Collateral & Co-Applicant Decisions

Foreign EduLoans does NOT advise on whether to pledge specific collateral, whether a particular family member should be a co-applicant, implications of being a co-applicant, or liabilities arising from co-applicant status.

These decisions should be made after obtaining appropriate professional advice.

15Intellectual Property

15.1 Ownership of Content

All content on the Platform, including text, graphics, logos, icons, images, tool interfaces, calculators, comparison charts, software code, and database content, is the exclusive property of Gateway Educonnect or its licensors and is protected under applicable laws.

15.2 Partner Institution Intellectual Property

Partner Institution names, logos, trademarks, and branding displayed on the Platform belong to their respective owners and are used on the Platform for identification and informational purposes only. Their use does NOT imply endorsement of Foreign EduLoans by those institutions unless otherwise agreed in writing.

15.3 Permitted Use

You may use the Platform for your own personal, non-commercial purpose of seeking loan assistance only.

You may NOT copy, reproduce, republish, distribute, transmit, modify, adapt, translate, create derivative works, publicly display, perform, broadcast, exploit, sublicense, sell, transfer, reverse-engineer, or decompile Platform content or software, or remove or alter any copyright, trademark, or proprietary notice.

16Privacy, Data Protection & DPDPA Compliance

16.1 Privacy Policy Governance

Your use of the Platform is governed by our Privacy Policy, which describes how we collect, use, store, process, and share your personal data, your rights under applicable data-protection law, grievance-redressal mechanisms, and cookie usage.

16.2 Legal Framework

Foreign EduLoans processes personal data in accordance with the Digital Personal Data Protection Act, 2023 ("DPDPA") and other applicable data-protection laws and regulations.

16.3 Data Processing

Foreign EduLoans processes personal data with the consent of the Data Principal or where such processing is permitted under the DPDPA and other applicable law, including applicable legitimate uses and legal or regulatory requirements.

16.4 Data Retention

Personal data is retained for:

  • The duration of service provision, including loan processing and facilitation;
  • Plus 8 years after loan disbursement or application closure, consistent with the retention period stated in our Privacy Policy, and reflecting Foreign EduLoans' obligations under applicable tax, anti-money-laundering, and other statutory record-keeping requirements; and
  • Applicable statutory retention periods, including where required for tax, anti-money-laundering, regulatory, dispute-resolution, or other legal purposes.

Data will be securely deleted after the applicable retention period unless legally required to be retained.

16.5 Data Security Measures & Breach Notification

Foreign EduLoans adopts the following security practices:

  • Encryption - Data encrypted in transit (TLS/SSL) and at rest (AES-256 or equivalent);
  • Access controls - Role-based access, authentication, and authorization;
  • Regular audits - Periodic security assessments and vulnerability testing;
  • Employee training - Data protection and confidentiality training for all staff;
  • Incident response - Documented procedures for data breach detection, containment, and notification; in the event of a Personal Data Breach, Foreign EduLoans will notify the Data Protection Board and affected Data Principals in the form, manner, and timelines prescribed under applicable law; and
  • Third-party compliance - Contractual obligations on service providers and Partner Institutions.

Limitation: Foreign EduLoans cannot guarantee absolute security of data transmitted over the internet or stored on any system. Internet-based communications carry inherent risks, including but not limited to interception, unauthorised access, and transmission errors, which cannot be entirely eliminated despite reasonable security measures.

16.6 Cross-Border Data Transfer

Foreign EduLoans currently stores and processes personal data within India and does not transfer personal data outside India.

Any future transfer of personal data outside India shall be undertaken in accordance with the DPDPA and other applicable law.

16.7 Data Principal Rights, Including the Right to Nominate

In addition to the rights described in our Privacy Policy, you may exercise rights available to you under applicable data-protection law, including applicable rights relating to access, correction, erasure, grievance redressal, withdrawal of consent, and nomination.

Requests may be submitted to our Grievance Officer using the contact details in Section 21.

16.8 Grievance Redressal - Data Protection

For data-protection-related complaints, contact our Grievance Officer at the details provided in Section 21.

Foreign EduLoans will acknowledge and address such complaints in accordance with applicable law and its applicable grievance-redressal process.

Complaints may be escalated to the appropriate authority where permitted under applicable law.

16.9 Processing of Children's Personal Data

Foreign EduLoans' processing of a minor's personal data, including the requirement of verifiable parental or guardian consent, is governed by Section 5.3.

17Additional Disclaimers

17.1 Accuracy of Partner Institution Information

Interest rates, eligibility criteria, sanction limits, processing timelines, and other loan-related information displayed on the Platform or communicated to you by Foreign EduLoans are based on information provided by the relevant Partner Institution or otherwise publicly available at the time of communication.

Foreign EduLoans does NOT independently verify, audit, or guarantee the accuracy, currency, or completeness of Partner Institution information and shall NOT be held liable for any loss, inconvenience, or adverse consequence arising from a Partner Institution's information being inaccurate, outdated, incomplete, or subsequently revised by that Partner Institution.

You are strongly advised to independently confirm all rates, eligibility criteria, and terms directly with the Partner Institution before relying on them or making any financial decision.

17.2 No Fiduciary, Agency, Partnership, or Joint Venture Relationship

Nothing contained in these Terms, the Privacy Policy, or arising from your use of the Platform shall be construed as creating any fiduciary relationship, agency relationship, partnership, joint venture, employment relationship, or financial-advisory relationship between you and Foreign EduLoans, or between Foreign EduLoans and any Partner Institution.

Foreign EduLoans acts solely as an independent facilitator and advisor, and neither you nor any Partner Institution has authority to bind Foreign EduLoans to any obligation, representation, or commitment.

17.3 Platform Availability Disclaimer

The Platform and all Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Platform will be uninterrupted, timely, secure, or error-free. The Platform may from time to time be unavailable due to scheduled maintenance or unplanned downtime.

Foreign EduLoans does NOT warrant that defects will be corrected or that the Platform or servers that make it available are free of viruses or other harmful components.

You access and use the Platform at your own risk, and Foreign EduLoans shall NOT be liable for loss or damage arising from Platform downtime, technical errors, maintenance windows, or service interruptions, except to the extent such liability cannot be excluded under applicable law.

17.4 Non-Waiver

No failure or delay by Foreign EduLoans in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy.

Any waiver of any provision of these Terms shall be effective only if made in writing and signed by an authorised representative of Foreign EduLoans and shall apply only to the specific instance and purpose for which it is given.

17.5 Commission / Referral Fees

Foreign EduLoans may receive a commission or referral fee from a Partner Institution for successfully facilitated loan applications.

Such commission or referral fee is paid by the Partner Institution and does not constitute an additional fee payable by you to Foreign EduLoans. Foreign EduLoans does not charge Users any service fee for its loan-facilitation Services.

The applicable loan terms, including interest rate, processing fees, charges, and other conditions, are determined by the relevant Partner Institution.

You may request information regarding any commission or referral fee applicable to your specific application by contacting us using the details in Section 21.

Foreign EduLoans is not responsible or obligated to pass on, share, or pay to you any commission or referral fee it earns from a Partner Institution; such commission is Foreign EduLoans' own earning for facilitation services rendered and is separate from any offer, discount, or cashback that a Partner Institution or Foreign EduLoans may independently extend to you.

If any offer, discount, or cashback communicated to you by Foreign EduLoans is not honoured or is not functioning as described, you should report the matter to our Grievance Officer at the details in Section 21 without delay, and Foreign EduLoans will address the complaint on a timely basis.

18Limitation of Liability

18.1 Extent of Limitation

To the maximum extent permitted under applicable Indian law, Foreign EduLoans, its parent entity, affiliates, directors, officers, employees, agents, and representatives shall NOT be liable for direct, indirect, incidental, consequential, special, punitive, or exemplary damages, loss of profits, revenue, data, or opportunity, loss of goodwill or business reputation, loss of admission, visa opportunity, or educational opportunity, financial loss or cost of substitute services, or damages arising out of or in connection with your use of the Platform.

This applies regardless of whether Foreign EduLoans has been advised of the possibility of such damages and regardless of the legal theory.

18.2 Aggregate Liability Cap

Foreign EduLoans' total aggregate liability to you for any claim arising out of or relating to these Terms or the Services, regardless of the form of action, shall NOT exceed: the amount actually paid by you to Foreign EduLoans as a service fee for the specific transaction giving rise to the claim, if any, OR INR 500/- (Five Hundred Rupees), whichever is greater, excluding any amount paid directly to a Partner Institution.

18.3 No Liability for Partner Institution Actions

Foreign EduLoans shall NOT be liable for any act, omission, negligence, decision, delay, error, fraud, or breach committed by any Partner Institution, including loan approval, rejection, or modification decisions, interest-rate determination or adjustment, processing or underwriting decisions, loan disbursement or non-disbursement, loan servicing or charge assessment, data handling or security failures, unfair lending practices or discrimination, breach of loan agreement terms, or default action, except to the extent caused by Foreign EduLoans' own acts, omissions, negligence, wilful misconduct, or breach of applicable law.

18.4 Statutory Carve-Outs - Non-Excludable Liability

Nothing in this Section shall exclude or limit liability that cannot be excluded or limited under applicable Indian law.

19Indemnification

19.1 User Indemnification Obligation

You agree to indemnify, defend, and hold harmless Foreign EduLoans, its parent entity, affiliates, directors, officers, employees, and agents from and against claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable legal fees and court costs, arising out of or related to the triggers below.

19.2 Indemnification Triggers

  • Your breach of any provision of these Terms or any representation/warranty;
  • Inaccurate, false, or misleading information or documents provided by you;
  • Your violation of applicable law, regulation, or rights of any third party;
  • Your misuse of the Platform;
  • Disputes between you and a Partner Institution arising from your loan application, loan agreement, or repayment;
  • Intellectual-property infringement arising from content you submit or provide; or
  • Your violation of a Partner Institution's terms or policies.

19.3 Defence & Control

Foreign EduLoans may assume the defence of any indemnified claim, participate in defence through counsel of its choice, or settle claims, provided you are consulted in advance where reasonably practicable.

You shall cooperate fully with Foreign EduLoans in the defence of claims.

19.4 Carve-Outs & Limitations

The indemnification obligation does NOT apply to claims arising from Foreign EduLoans' own gross negligence, wilful default, fraud, violation of law, breach of these Terms, or claims not arising from your conduct or information.

20Grievance Redressal & Complaint Handling

20.1 Structured Grievance Mechanism

Foreign EduLoans is committed to prompt and fair resolution of complaints and grievances and maintains a dedicated grievance-redressal system.

20.2 Complaint Categories

We handle complaints regarding service delays, communication issues, data-related complaints, misrepresentation, technical issues, conduct complaints, and billing disputes.

Data-protection and privacy complaints are handled under the specific process in Section 16.8.

20.4 Complaint Processing Timeline

Total timeline for resolution of general complaints: 120 business days maximum.

Data-protection and privacy complaints are handled under the specific process set out in Section 16.8.

20.5 Escalation Path

If a complaint is not resolved satisfactorily:

  • Foreign EduLoans Management Review escalate to Senior Management within 5 days of closure; and
  • Relevant governmental departments or authorities, as applicable under law.

20.6 Remedy Options

Depending on the nature of the complaint, Foreign EduLoans may provide:

  • An apology and explanation;
  • Process correction;
  • Compensation for financial loss suffered due to Foreign EduLoans' negligence;
  • Service restoration; or
  • Assisted application resubmission.

20.7 No Complaint as Admission

Filing a complaint does NOT constitute an admission of liability by Foreign EduLoans. However, complaints will be investigated fairly and objectively.

22Legal Compliance

22.1 Regulatory Reporting

Foreign EduLoans may cooperate with the Financial Intelligence Unit - India and other competent regulatory or law-enforcement authorities, and may make disclosures or reports, including in relation to suspicious transactions, where required or permitted by applicable law.

22.2 Your Obligations

You agree to provide genuine and verified KYC documents where required, cooperate fully with verification procedures, disclose information relating to source of funds where legally required, and comply with applicable laws, including the Foreign Exchange Management Act, 1999 (FEMA), where applicable.

23Prohibited Use & Enforcement

23.1 Prohibited Activities

You shall NOT, and shall NOT permit any third party to:

  • Use the Platform for any unlawful purpose or in a manner violating applicable law;
  • Submit fraudulent, forged, or materially false information, documents, or representations;
  • Impersonate any person or entity or misrepresent affiliation;
  • Attempt unauthorised access to Platform servers, systems, or data;
  • Introduce viruses, malware, ransomware, or harmful code;
  • Engage in activity that disrupts or interferes with Platform functioning;
  • Scrape, harvest, or collect data using automated means without written consent;
  • Harass, defame, threaten, or transmit unsolicited communications to staff or other users;
  • Reverse-engineer, decompile, or extract Platform source code;
  • Violate intellectual-property rights of Foreign EduLoans or others;
  • Engage in money laundering, fraud, or financial crimes; or
  • Use the Platform for terrorist financing or sanctions evasion.

23.2 Investigation & Enforcement

Foreign EduLoans reserves the right to investigate suspected violations, suspend or terminate access immediately where appropriate, report matters to law-enforcement or regulatory authorities, pursue civil or criminal remedies where available, cooperate with government investigations, and claim damages for losses incurred, subject to applicable law.

23.3 Reporting to the Financial Intelligence Unit

Where required under the Prevention of Money-Laundering Act, 2002 and applicable rules, Foreign EduLoans or the relevant Partner Institution may report suspicious transactions, cash transactions, or other prescribed information to the Financial Intelligence Unit - India (FIU-IND) or such other authority as may be designated. Foreign EduLoans shall not be liable to a User for any such disclosure made in good faith and in compliance with applicable law.

24Modification of Terms

24.1 Right to Amend

Foreign EduLoans reserves the right to amend, update, or modify these Terms at its discretion to reflect changes in applicable law or regulatory requirements, respond to regulatory or consumer-protection standards, adapt to business practices or Platform functionality changes, or enhance user protection or data security.

24.2 Notice of Changes

  • Revised Terms will be posted on the Platform with an updated "Last Updated" date.
  • Material changes will be notified through the Platform notification dashboard, and WhatsApp or SMS to your registered mobile, where applicable, with a minimum 15 days' notice before the material change takes effect.

24.3 Acceptance of Modified Terms

Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

If you do NOT accept the modified Terms, you must discontinue use of the Platform.

We encourage you to review these Terms periodically for changes.

25Suspension or Termination

25.1 Termination by Foreign EduLoans

Foreign EduLoans reserves the right, subject to applicable law, to suspend, restrict, or terminate your access to the Platform, in whole or in part, immediately and without prior notice if:

  • You breach any provision of these Terms;
  • You provide false, fraudulent, or misleading information;
  • Your use poses a security, legal, or material reputational risk to Foreign EduLoans or Partner Institutions;
  • Foreign EduLoans is required to do so by law;
  • Foreign EduLoans detects suspicious activity or potential money laundering; or
  • Your conduct violates applicable Partner Institution policies.

25.2 Termination by User

You may discontinue use of the Platform and request account closure at any time by contacting us under Section 21.

Upon request, Foreign EduLoans will close your account within 15 business days and cease processing applications, if not already submitted, subject to applicable law and necessary retention obligations.

25.3 Effect of Termination

Termination does NOT affect:

  • Rights or obligations accrued prior to termination;
  • Survival of applicable provisions including disclaimers, limitation of liability, indemnification, governing law, and dispute provisions;
  • A Partner Institution's ongoing loan processing or loan agreement;
  • Data-retention obligations under law; or
  • Obligations to cooperate with regulatory or law-enforcement investigations.
26Force Majeure

26.1 Non-Liability for External Events

Foreign EduLoans shall NOT be held liable for delay or failure in performance of its Services resulting from causes beyond its reasonable control, including acts of God, natural disasters, floods, earthquakes, hurricanes, pandemics, epidemics, public-health emergencies, war, terrorism, armed conflict, riots, civil unrest, strikes, governmental action or regulatory change, internet or telecommunications failure or service disruption, failure of a Partner Institution's systems or services, failure of third-party service providers, or cyberattacks or data breaches, except to the extent liability cannot lawfully be excluded.

26.2 Mitigation Obligation

Despite the force-majeure clause, Foreign EduLoans will make reasonable efforts to restore services, communicate status updates to affected users, and assist with alternative arrangements where feasible.

26.3 No Liability Extension

Force majeure does NOT excuse Foreign EduLoans from liability arising from its own wilful default, gross negligence, or inadequate security measures where such liability cannot lawfully be excluded.

27Governing Law & Jurisdiction

27.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

27.2 Exclusive Jurisdiction

Subject to any mandatory consumer-protection jurisdiction available to you under applicable law, including the Consumer Protection Act, 2019, any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts at Udaipur, Rajasthan, India.

Both parties agree to submit to such jurisdiction to the extent permitted by applicable law.

27.3 Alternative Dispute Resolution

Before initiating court proceedings, the parties may mutually agree to mediation through a neutral third-party mediator under applicable law or arbitration under the Arbitration and Conciliation Act, 1996, if mutually agreed.

28Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent court, such provision shall be severed or limited to the minimum extent necessary, without affecting the validity and enforceability of the remaining provisions.

The remaining Terms shall continue in full force and effect.

Foreign EduLoans shall not be responsible or liable for any damage, loss, or consequence caused to a User arising from a provision being severed, limited, or held invalid, illegal, or unenforceable under this Section.

29Entire Agreement

These Terms, together with our Privacy Policy and applicable Data Protection Policy, constitute the agreement between you and Foreign EduLoans regarding your use of the Platform, the Services provided, and the loan-facilitation process.

These Terms supersede prior discussions, negotiations, agreements, and understandings concerning the same subject matter, except to the extent otherwise required by applicable law.

30Schedule A - Definitions
  • "Applicant" - Any person seeking education-loan information or assistance through the Platform.
  • "Co-applicant" - A family member or other person who co-guarantees or co-borrows an education loan alongside the primary applicant, as applicable under the relevant loan agreement.
  • "Fraud" or "Fraudulent" - Any act involving dishonest concealment, misrepresentation, or falsification of information or documents, intended to deceive Foreign EduLoans or a Partner Institution or to secure a wrongful gain or advantage.
  • "Phishing" - A fraudulent attempt to obtain sensitive information, such as login credentials, OTPs, or financial details, by impersonating Foreign EduLoans, a Partner Institution, or another trusted entity through email, SMS, calls, or other electronic means.
  • "Internet-based Means of Communication" - Any mode of communication conducted over the internet, including email, WhatsApp, SMS gateways, website forms, and calls made or assisted through internet-based systems.
  • "TAT" - Turnaround Time; the indicative period within which a step in the loan-facilitation process is expected to be completed.
  • "Sanction" - The formal approval of a loan application by a Partner Institution, specifying the approved loan amount and terms, prior to disbursement.
  • "Interest Rate" - The rate, expressed as a percentage, charged by a Partner Institution on the principal amount of a loan, as determined solely by that Partner Institution.
  • "Principal Amount" - The original sum of money borrowed under a loan, excluding interest and other charges.
  • "Instalment" - A part-payment of a loan, comprising principal and/or interest, payable by the borrower to the Partner Institution at agreed intervals as per the loan agreement.
  • "Loan Proposal" - An application or request submitted for a Partner Institution's consideration for the sanction of an education loan.
  • "Lien" - A Partner Institution's legal right to retain or hold an asset, security, or deposit as protection against a User's outstanding obligation, until that obligation is satisfied.
  • "Mortgage" - The transfer of an interest in immovable property by a User to a Partner Institution as security for a loan, repayable upon discharge of the loan.
  • "Jurisdiction" - The legal authority of a specified court or forum to hear and decide a dispute, as set out in Section 27.
  • "Guarantor" - A person who undertakes to a Partner Institution to be responsible for a borrower's loan obligation if the borrower fails to fulfil it, as required under the relevant loan agreement.
  • "ROI" - Rate of Interest; used interchangeably with "Interest Rate" as defined above.
  • "Data Fiduciary and Data Principal" - The terms as defined under the Digital Personal Data Protection Act, 2023, where applicable.
  • "Education Loan" - A loan product offered by Partner Institutions specifically for financing education in India or abroad.
  • "Foreign EduLoans" - The Platform and services operated by Gateway Educonnect
  • "KYC" - Know Your Customer; the process of verifying customer identity and collecting relevant personal information in accordance with applicable law and regulatory requirements.
  • "NBFC" - Non-Banking Financial Company as defined under applicable RBI regulations.
  • "Partner Institution" - A bank, NBFC, or other financial institution offering education-loan products and formally partnering with Foreign EduLoans for loan facilitation.
  • "Platform" - The Foreign EduLoans website and related digital services, including foreigneduloans.com, and any replacement or successor platform operated by Foreign EduLoans.
  • "RBI" - Reserve Bank of India.
  • "User" - A student, parent, or legal guardian (in the case of a minor) accessing or using the Platform.
